Tellway terms of use

These terms are the agreement between you and MapMap AI Ltd for your use of Tellway. They are short on purpose. Please read section 2 before your first drive.
1. Who we are, and how you accept these terms
Tellway is provided by MapMap AI Ltd, trading as MapMap, a company registered in England and Wales (company number 17345596), whose registered office is Vantage Point, New England Road, Brighton, England, BN1 4GW (“MapMap”, “we”, “us”).
You accept these terms when you continue past the sign-in screen, either by entering your email address or by choosing “Skip for now”, and Tellway is issued its key. The sign-in screen links to these terms and to our privacy policy before you continue. If you do not accept these terms, do not use Tellway.
You must be 18 or over to use Tellway.
These terms are the whole agreement for your use of the Tellway app. Our API terms of service are for businesses and developers who use our hosted API directly, and do not apply to your personal use of Tellway, even though Tellway uses that API to work.
Our Tellway privacy policy explains what Tellway does with your data. It is not part of these terms, but please read it.
2. Safety comes first
Tellway is an aid to navigation. You are always responsible for how you drive, and for driving safely and within the law.
- Obey the law, road signs, road markings and traffic signals, and the directions of the police and other authorities, even where Tellway says something different. A sign on the road always wins over the app.
- Drive to the conditions. Tellway does not know about the weather, the traffic in front of you, temporary signs or a road that has changed since our data was made.
- Never hold your phone while driving. In the UK it is against the law to hold and use a phone while driving, including while you are stopped in traffic. Set your destination before you set off, and if you need to change it, stop somewhere safe and legal first. Keep your phone in a secure holder that does not block your view of the road. Even with your phone in a holder, you can be prosecuted if you are not in proper control of your vehicle.
- “Hold to speak” needs a touch. Use it only when your phone is in a holder and it is safe to do so, as you would any other control in your car. If in doubt, do not touch the phone while driving.
- Questions Tellway asks you are optional. Tellway may ask you a short question out loud, such as “Slow here. Is it a queue?”, and then listen for a few seconds without a touch. You never have to answer, and saying nothing is always fine. You can switch these questions off in Settings.
- Check before you take a different route. Tellway may tell you about a faster route and let you take it by saying “faster route”. Only take it if you can do so safely, and follow the road signs.
- Do not rely on Tellway for warnings. Speed limits, road incidents, traffic and reports from other drivers may be missing, late, out of date or wrong. Road incident information from National Highways covers its strategic road network in England only.
- Listen at a safe volume that still lets you hear what is going on around you, including emergency vehicles.
3. What Tellway is, and what we do not promise
Tellway is a free, voice-first navigation app. It tells you the way out loud and has no map.
We work hard to make it accurate, but we cannot promise that:
- a route is the best, the quickest, legal or suitable for your vehicle, or that a road on it is open;
- journey times, arrival times, traffic and departure times are right: they are estimates;
- spoken instructions, speed limits, road incidents or reports from other drivers are complete, correct or up to date;
- your phone's location is accurate, or that guidance carries on if your phone, its signal, its battery or its location service fails;
- every instruction is spoken. With no connection, an instruction Tellway has no recorded clip for is not spoken;
- Tellway will always be available, or available without interruption or errors.
Map and routing data come from OpenStreetMap and other open sources, which anyone can edit and which can be wrong. Map data © OpenStreetMap contributors, available under the Open Database Licence. Tellway credits it in the app, under What we know, Licences, and on the route picture.
We may change Tellway, add or remove features, or stop offering it. If we decide to stop offering it, we will tell you in the app at least 30 days before it stops working, unless the law or a security problem means we cannot.
4. Your MapMap key
Tellway runs on a key that MapMap issues to your phone when you sign in. The key connects Tellway to our services at api.mapmap.ai and sets your allowance.
- The key is for use with Tellway on your phone only. Do not copy it out of the app, share it, sell it or use it with any other software.
- The key has an allowance. If you choose “Skip for now”, the key works for search and routes up to a monthly allowance and cannot download offline areas. If you sign in with your email address, the key has a small allowance and stops working after 72 hours until you confirm the address. Confirming an email address, by link or by code, moves the key to the free allowance and unlocks offline area downloads. If you reach your allowance, online features stop until it resets. We may change allowances.
- One app, one key. Your Tellway key is separate from any MapMap Nav or MapMap API key on the same email address.
- We may suspend or revoke a key that breaks these terms, is used to abuse our services, or where the law requires it. Where it is reasonable to do so, we will tell you first.
- Deleting your account in Settings revokes your Tellway key straight away. The privacy policy explains what else is deleted.
5. Reports you send
You can tell us about the road: a road report by voice command (“report a closed road”, “report roadworks”), or an answer to a traffic question such as “Slow here. Is it a queue?”.
- Only report what you believe is true.
- You allow us to use what you report to check and improve our map and routing, and, for traffic reports, to warn other drivers. Other drivers never see who sent a report.
- We may decide not to use a report, and we may remove it at any time.
6. Acceptable use
You must not:
- use Tellway in a way that breaks the law or puts anyone at risk;
- try to get around the key, its allowance, rate limits or sign-up limits, for example by signing up repeatedly;
- copy, extract or resell our data or services, or use them to build a competing product, except as the licences of the underlying open data allow;
- interfere with, overload, probe or reverse-engineer our services, except as the law allows;
- send false, misleading or abusive road or traffic reports.
7. Price
Tellway is free to use, and there are no in-app purchases. Your mobile network may charge you for the data Tellway uses, especially for offline area downloads, which can be several gigabytes.
8. Our responsibility to you
- What we do not exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Nothing in these terms affects your legal rights as a consumer.
- Foreseeable loss. If we break these terms or fail to use reasonable care and skill, we are responsible for loss you suffer that was a foreseeable result. We are not responsible for loss that was not foreseeable.
- Damage to your phone. If Tellway damages your phone or other digital content belonging to you because we did not use reasonable care and skill, we will either repair the damage or pay you compensation. We are not responsible for damage you could have avoided by installing an update we offered you free of charge, or by using a phone and operating system that Tellway supports.
- Private use only. Tellway is for domestic and private use. We are not responsible for any loss of profit, business, business opportunity or business interruption.
- Driving decisions are yours. We are not responsible for loss caused by your not following section 2, including fines, penalty points, or loss arising from following an instruction that conflicts with a road sign or with the law.
- Limit. Because Tellway is free, and except for the things listed under “What we do not exclude” and “Damage to your phone”, our total liability to you in connection with Tellway is limited to £100.
9. The App Store and Google Play
If you got Tellway from Apple's App Store or Google Play, these terms are between you and MapMap only, not Apple or Google, and MapMap alone is responsible for Tellway and its content. Apple and Google have no obligation to provide any maintenance or support for Tellway, and are not responsible for any claim by you or anyone else relating to Tellway. Your use of Tellway must also follow the rules of the store you got it from. If you got Tellway from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Ending your use
You can stop using Tellway at any time, and delete your account in Settings or by emailing support@mapmap.ai. We may suspend or end your access as set out in section 4. Sections 2, 3, 5, 6 and 8 continue to apply after your use ends.
11. Changes to these terms
We may update these terms, for example when Tellway changes or the law changes. We will update the date at the top of this page. For a change that is to your disadvantage, we will tell you in the app at least 30 days before it takes effect, unless the change is needed sooner because of the law, safety or security. If you do not accept a change, you can stop using Tellway and delete your account before it takes effect.
12. Law and courts
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland, and if you live in Northern Ireland, in Northern Ireland. If you live outside the United Kingdom, these terms do not take away any protection you have under the mandatory consumer law of the country where you live.
